Honest study of the Constitution for the united States of America, laws of the Union, constitutions of the several States, state statutes, and writings of the Founders of our Republic reveals clearly that the Militia is a "citizens army" made up of the "whole of the people," for the purpose of guarding against "betrayal by their representatives," to "afford complete security against the invasions of public liberty by the national authority," and if either occurs it is their right, their duty, "to throw off such government, and to provide new guards for their future security." A militiaman is simply any citizen in his capacity as a defender of the community, who is obliged to do so within his or her ability. Militiahood is a role which citizens may play as the situation requires. It is not a permanent condition. But just as each citizen has a duty to defend the community, he also has the duty to prepare himself to play that role effectively, and to join with others in his community to train and to function as organized forces, and the elected officials of his community have the duty to facilitate that organization and training. נכון שהמיליציה מורכבת מכל גבר בגילאים מתאימים (ותחשבי בעצמך מה זה עושה לזכות הנשים לשאת נשק), אולם זוהי זכותה של המדינה להחליט איך היא מעוניינת לצייד את ה-Well Regulated Militia. אציין כי בית המשפט העליון קבע באופן חד-משמעי שהתיקון השני ישים רק לכלי נשק העשויים לשמש את המיליציה (ולא כלי נשק העשויים לשמש פרטים פוטנציאלים בה, כלומר אותם גברים עליהם דיברת). בפסיקה Burton v. הציטוט שהבאת, המסביר מהם The People, הינו מפסק דין אשר הסביר מדוע ל-nonresident aliens אין את הזכות של The People, ולכן אינו סותר את מה שציטטתי - פסק דין אשר אושר ע"י בית המשפט העליון. אודה לך אם תשתדלי שלא להוציא דברים מהקשרם. זה גורם להם להישמע כאילו הם אומרים דברים שונים לחלוטין, ובכלל זה פסק דין Miranda המפורסם (שלא עסק כלל בתיקון השני לחוקה). בנוגע ל-clean and unambiguous language of the constitution, לדעתי הענווה ניתן היה לנסח את התיקון השני בצורה ברורה יותר. אינני חושב שיש סעיף שמשמעותו שנויה במחלוקת כמו התיקון השני. טל.

אתה אומר: "הציטוט שהבאת, המסביר מהם The People, הינו מפסק דין אשר הסביר מדוע ל-nonresident aliens אין את הזכות של The People, ולכן אינו סותר את מה שציטטתי - פסק דין אשר אושר ע"י בית המשפט העליון."- דווקא זה מאוד סותר! זרים שאינם תושבים אינם זכאים לאותם זכויות של תושבי ואזרחי המדינה. לי אין כל בעיה עם זה ואני מסכימה לחלוטין. אבל: זה כן אומר שהאנשים, כפי שתרגמתי: קרי האזרחים והתושבים: זכויותיהם מוגדרות ומוגנות על ידי שמונת התיקונים הראשונים! הווה אומר: זכותם להתאסף, זכותם לשאת נשק, זכותם שלא יעקלו או יחפשו רכוש שלהם ללא ביסוס וכו'. ובאשר לפסיקת מירנדה על ידי בית המשפט העליון של מדינתי האהובה אריזונה, אוי, כמה שאתה טועה זה ממש לא מצחיק! פסיקה זו מכסה לא רק את התיקון השני אלא את כל הזכויות כפי שהן ניתנו לנו, התושבים ואזרחי המדינה. תקרא שוב: "Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them." Miranda vs. Arizona RIGHTS: בלשון רבים, קרי לא רק לזכות לשאת נשק המוענקת לנו האנשים בתיקון השני אלא כל שאר הזכויות המוענקות לנו בתיקונים כפי שהם מעוגנים בחוקה! התיקון השני מנוסח בצורה מאוד ברורה ונהירה: "...זכותם של האנשים להחזיק ולשאת נשק אינה ניתנת להפרה". ובאמת שאין לי כוח להביא שוב את הציטוטים המספקים הגדרה של המיליציה, כמו גם דבריהם של האבות המייסדים שהבהירו מעבר לכל צל של ספק שאפילו לא קיים למה הם התכוונו בתיקון הזה (כמו גם בשאר הדברים המפורטים בחוקה). אם אתה מסוגל לפרש את זכותם של האנשים להחזיק ולשאת נשק כבלתי ניתנת להפרה שהכוונה היא בעצם זכותן של המדינות, נו באמת... מיכל פניקס, אריזונה

מה לעשות

מיכל, אם האבות המייסדים היו רוצים לומר "זכותם של האנשים להחזיק ולשאת נשק אינה ניתנת להפרה", הם היו אומרים את זה ולא שמים את זה כהמשך למשפט המדבר על מדינות חופשיות ו-Well regulated militia. את אומרת שהוא מנוסח בצורה מאוד ברורה ונהירה, אבל בוחרת להתחיל לצטט אותו בשלוש נקודות. כשאת מתווכחת איתי זה דבר אחד, אבל כשאת מתעלמת מהלכות פסוקות של בית המשפט העליון באמצעות פרשנויות, ציטוטים שהוצאו מהקשרם ולהטוטים מילוליים, זה דבר שונה בתכלית. כשאת שוכחת שב-Washington DC נשיאת נשק נאסרה לפני למעלה מ-25 שנים וזה לא פוגע בחוקה, כשאת מקשיבה רק לעצמך, זה נעשה טיפה עצוב או טיפה משעשע (תלוי בנקודת המבט). אני סיימתי. באמת שאין לי יותר מה לומר בנושא. טל.

בקשר לוושינגטון DC:

טל, וושינגטון DC מוזכרת בחוקה, בהקשר שהיא מוצהרת כשטח פדרלי. ככזה, לקונגרס יש את הזכות להעביר איזה חוקים שמתחשק להם שם, כולל איסור נשיאת כלי נשק. ("TO EXCERCISE EXCLUSIVE LEGISTLATION IN ALL CASES WHATSOEVER, OVER SUCH DISTRICT (NOT EXCEEDING TEN MILES SQUARE). עם זאת, זכות זו אינה קיימת בכל הנוגע למדינות. הווה אומר, המדינות לא תוכלנה להעביר חוק שכזה משום שהוא בלתי חוקתי וככזה הוא בטל ומבוטל מעצם קיומו (ואיש אינו חייב לציית לו). מיכל פניקס אריזונה

מעניין שמיכל יודעת טוב יותר מביהמ"ש

לטענתך DC הינה שטח פדרלי בו "לקונגרס יש את הזכות להעביר איזה חוקים שמתחשק להם שם, כולל איסור נשיאת כלי נשק". האם זה כולל שלילת התיקון הראשון? הרביעי והחמישי? מעניין שבערעור על האיסור לנשיאת נשק ב-DC אף אחד מהמשפטנים המלומדים - התובעים, הנתבעים והשופטים - לא חשב על DC כשטח אקס-טריטוריאלי אשר זכויות הפרט אינן חלות בו (Sandidge v. United States). מעניין שבית המשפט קבע שם כי:
"the right to keep and bear arms is not a right conferred upon the people by the federal constitution"​
ושהתיקון השני הוא:
"a collective right [of the states] rather than an individual right"​
כמו כן, האיסור לנשיאת נשק ב-DC (שניתן ע"י הרשאה לשאת רק נשק שנרשם כחוק, במקביל לאיסור לרשום כל סוג של נשק) לא נחקק ע"י הקונגרס, אבל למה שתתני לזוטות מסוג זה להטריד אותך. טל.

את ממש לא תופסת את זה

מיכל, אז מה אם החוקה מרשה או לא כן חופש או לא. החוקה גובשה לה לפני יותר ממאתיים שנה וכמו התנך וחוקיו שלא כל-כך רלבנטיים כיום הנה גם זה. נכון, אנשים יורים , אבל בעזרת רובים. צרלסטון הסטון - לא יעזור הוא רשע מרושע שהתפטרותו עשתה לי רק טוב. אין הבדל בינו לבין עובדיה יוסף - שניהם מקובעים, פרימיטיביים ולא רציונליים

בדיוק כך - מה שווה התיקון השני אם בשמו אפשר לבצע מעשי רצח באין מפריע? ילד בן 7 שיורה עם אקדח על חבריו לכיתה (רק מקרה אחד מרבים) זה לא סימן של חברה בריאה. כרגע הרווחים הכספיים של יצרני הנשק שווים יותר מחיי אדם, ולי זה נראה מעוות.

אם מישהו רוצה להרוג הוא ימצא דרך. לולא העובדה שרוב האנשים נשאו נשק ארה"ב הייתה עדיין תחת שליטה בריטית. התיקון השני מספק לאנשים עוד אמצעי ביטחון, שכן ככל שלמדינה יהיו יותר כוח וסמכויות, כן היא תתעלל באזרחיה ותושביה. וכמו שטובים וחכמים ממני אמרו: There is danger from all men.
