Gene Upshaw, the director of the NFL players association, has recently passed away (cancer). Human tragedy aside, this is very big news for the NFL. with the current agreement up for renegotiation soon (it expires next year if I'm not mistaken), and with gene being at risk of losing his job for appearing too soft in his negotiations with the league up to that point, he was proving to be quite a problem in these negotiations, turning down reasonable suggestions that where aimed for the long term growth and financial success of the league and by association of it's players and looking for a 'here and now' big pay-day agreement that he can take back to the players so that he won't lose his job. he found himself in a tough spot, and frankly I didn't see a way out of it for him, and neither did the league, who's alreadt begun to come to terms with the fact they're probably not going to be able to negotiate a new agreement. I'm sure you've all heard the talk of an 'uncapped year' coming soon. as it is now, whoever replaces upshaw will have a clean slate and some good will from the players with which to work, and could accept reasonable suggestions. this could be disaster averted for the NFL, since having an uncapped year would have resulted in small market teams taking a big hit (colts, bills & packers, to name a few) and naturally we would have seen the entire league spiral out of the balance that's made it so competitive and appealing for so many years. we'd have less fun, the league would lose money, owners would sell teams, and players will be getting less money... let me just be clear on one point - I was in no way pleased to hear of the untimely death of gene upshaw, cancer is a terrible thing that no man should have to go through. to be honest I was hoping he'd simply see the writing on the wall and either grow a pair of balls and make the deal that would likely get him fired or resign before making it. I've never wished him anything like this, and I have no joy in the fate that befell him. it's going to be very interesting to see who the NFLPA picks as his replacement.​

יש לו בכלל השפעה של החלטות שכאלה? אם אתה מעריך את זה כדבר רע, אני משער שיש עוד אנשים (עם קצת יותר כח והשפעה על הליגה, סלח לי שאני מציין את זה
) שמודעים לבעיות של מהלך שכזה. אני מבין שאתה מציין את זה כסיכון אפשרי, השאלה היא מה הסבירות לכזה מהלך? מה הסבירות שיטרפדו אותו והאם יש מספיק אנשים בעלי כח שתומכים בשינור ה"מסורת" של אפשו?

the owners and the NFLPA

the commissioner has absolutely no influence over the matter, at least not directly. the NFLPA represents the players in their negotiations with the league, they are two different organizations and so you could say they are on different sides of the fence on this one. the main issue here is that the owners find themselves paying so much of their share of the profits to the players that they're forced to choose between investing in the team & stadium or keeping the money in order to make a profit; naturally you can't expect the owners to lose money on their teams, and it goes without saying that if stadiums and facilities are left untended to it's just a matter of time before things start falling apart. so something had to change when it comes to the players' share of the organization's income, and quite naturally the players didn't like the idea. since upshaw had no power left with the players association, he couldn't convince anyone that taking a new contract that gives them less of a share (everything's calculated in percentages) in the profit is actually in their long term benefit. now, the owners will never agree to a new contract that's the same as the current one, because they aren't making any money (by their standards..) so a BIGGER new contract for the players is a pipe dream that just isn't going to happen, even if it means enduring a players' strike. so it's all a matter of how will the new director of the NFLPA view the situation. if he feels he can get a same or better deal we're all headed into a disaster scenario, because you know the owners are not going to bend when they think this deal will lose them money. if however he'll feel that taking a smaller percentage in what is an increasingly growing business will in the long run be a better deal than getting a larger percentage at the expense of the league's growth, than no one will ever feel a thing. there will be some negotiation, they'll strike some sort of deal and it'll be business as usual for the NFL. how likely is it that he'll view things one way or the other? well, since we don't even know who the guy will be, your guess is as good as mine.​

אני לא מתיימר להבין במו"מ ה-NFL, אבל זה קצת דומה למו"מ שמתנהל בארץ, בין הממשלה, ההסתדרות והמעסיקים. תמיד בתחילת המו"מ זה נראה חסר סיכוי, כי הצדדים כל כך רחוקים בעמדותיהם, ובסוף זה תמיד נגמר באיזושהי פשרה. כמעט תמיד מעורבת בכך שביתה, כי הצד החלש במו"מ (העובדים), חייבים להראות שהם מוכנים לשלם את המחיר על מנת לשפר את מצבם, ומוכנים לפגוע בציבור כולו. גם שם, וגם במקרה הזה, המו"מ מוכרע רק אחרי שהצד החזק (הממשלה/מעסיקים, או הליגה/הבעלים) ספגו פגיעה מספקת, על מנת שהם יחליטו לוותר על חלק מהעמדות שלהם. כאמור, זה נובע בעיקר מהעובדה שהם מתחילים את המו"מ בגישה כוחנית של "למה מה תעשו לנו?", ורק לחץ ציבורי מכריע אותם (בגלל זה לשביתה של חברת חשמל יש יותר כוח מאשר לשביתה של המורים, ולמורים יש יותר כוח מאשר לפועלי הנקיון). אגב, בעניין הזה טוב שמעורבים פוליטיקאים, כי אם הייתם נותנים לפקידי האוצר ("שתישרף מהמדינה העיקר שלא תיפרץ מסגרת התקציב"), זה לא היה נגמר אף פעם. במקרה של ה-NFL, יכול להיות שחלק מהפתרון יכלול גם בדיקה מחודשת של החוזים עם הטלוויזיה, כדי להגדיל את העוגה, מה שיערב גורם נוסף, אבל עשוי להוות פתרון לבעיית "מסגרת התקציב". מאידך, הליגה עשויה להשפיע בדרישות לגבי טיפוח המגרשים, וליצוג מצב בו הבעלים "נאלצים" להתנגד לכל תוספת שכר, ולטעון שתוספת השכר תביא להתמוטטות הענף (כמו שהמעסיקים תמיד טוענים). בסופו של עניין, זה ייגמר כמו תמיד - אחרי שביתה, שכנראה לא תהיה ארוכה במיוחד (כי לעובדים, במקרה הזה, יש הרבה מאוד מה להפסיד. מדובר בהמון כסף, לא כמו אצל המורים), וכאשר כל הטענות כאילו "אי אפשר לחרוג..." יתבררו כלא נכונות.

if I'm not mistaken

the TV contracts have just recently ended and been resigned with another network, for something along the lines of an 8 or 10 year deal, so I can't see how the NFL can ask to renegotiate, especially seeing how they have no leverage. "please pay us more because we have internal problems" usually doesn't work too well in business, but I could be wrong. the one thing we know is that the NFL and it's owners are willing to do almost anything to avoid a strike, but they can't afford to lose money. and that's the situation that they're faced with right now. the only question is how understanding the NFLPA will be with their demands. the best solution I can think of is something along the lines of changing the way the NFL counts it's money so that the percentage spent on players' salary remains the same, but instead of applying that percentage to the gross profits it'll be applied to some form of net profit. for example forming an NFL fund responsible for the renovations of existing stadiums and their rebuilding once every X years. that way the cake that's being divided just got smaller, because tens of millions yearly will go into the fund as general expenses and whatever remains then gets spread around as usual, and out of these funds the players can now get their percentage. this way the NFLPA can save face by making the players feel they got a decent deal while addressing the NFL's problems, while it'll help keep the NFL profitable enough for the owners to remain involved in... so that's more or less how I see this playing out. I doubt we'll ever see a strike, especially with the NHL's strike still fresh in their memories. that strike basically put them out of business for a few years, and the NHL is still struggling to get back to the levels of popularity it enjoyed before it. remember that the players get a share of the cake, and so no one wants to see the cake suffer. also keep in mind that they have two years of negotiations ahead of them, with one of those two an uncapped year that'll wreak havoc around the league, so the motivation will be there to get a deal done before one year goes by, let alone two. that's why I doubt a strike is coming, although it is not out of the realm of possibilities.​

יש המון בעיות עם הנושא

קודם כל, אף אחד לא יבוא ויגיד לרשתות "בבקשה תנו לנו עוד כסף". אין לי מושג איך נראים החוזים, אבל אם לרשתות יהיה ברור שבלי פתרון תהיה שביתה, אז גם הם מצטרפים לאלו שמאוד לא מעוניינים בשביתה. זה נזקים של מיליונים. הם יכולים להיות צודקים, אבל הם יכרתו את הענף שהם יושבים עליו. לכן, הפתרון בהחלט יכול לכלול אותם, מסיבות פרקטיות, גם אם לא משפטיות. כל זה, בהנחה שבאמת החוזים הם ארוכי טווח באופן שלא מאפשר השתחררות, דבר שגם הוא טעון בדיקה. ראיתי לא מעט ביקורת בביסבול, על הסכנה שבפתיחת השוק לכל המרבה במחיר (סיפור מני רמירז). אתה יוצא מנקודת הנחה שכולם פועלים בצורה רציונאלית, אבל זה ממש לא עובד ככה. יש המון בעיות שמתוארות בתורת המשחקים, שנוגעות לסיטואציות האלה. הכוכבים תופסים את עצמם באופן שונה מהשאר, והם יטענו שהם אלו שמביאים את הרייטינג ואת הכסף. מצד שני, השחקנים הפחות מפורסמים יטענו שאי אפשר בלעדיהם, ושהכוכבים ממילא עושים המון כסף מהפרסומות וכל מה שקשור בזה, ואז ייווצר לחץ פנימי בתוך הארגון. נראה לי שהכוכבים יוכלו להרשות לעצמם שביתה, גם בגלל הפרסומות, ולהם זה יהיה שווה את זה, כי הם ירצו כמה שיותר תחרות בין הקבוצות. בכלל לא ברור שהשחקנים ה"פשוטים" יהיו באותה גישה. הארגון עשוי לסבול מאוד מהנושא. גם בין הבעלים עשויות להתעורר מחלוקות לא פשוטות, בין הקבוצות העשירות, שיכולות להרשות לעצמן לשלם יותר כי יש להם בסיס רחב יותר של אוהדים, לקבוצות שלא יכולות לעשות את זה. האחרונות יהיו מוכנות לסבול שביתה קצרה, ובלבד שלא תהיה פריצה של התקציב הכולל, שעשויה להוביל אותם לפשיטת רגל, למכירת הקבוצה והעברתה למקום אחר, וכיו"ב. גם לא נראה לי העניין של הפרשות לקרנות. קודם כל, זה נראה כמעט סוציאליסטי, וזה יהיה קשה להעביר בארה"ב. חוץ מזה, אם בסופו של יום לא יראו את ההבדל בתלוש, אז לארגון יהיה מאוד קשה לסובב את זה כהצלחה. כן, היו שביתות בעבר. חלקן קצרות וחלקן ארוכות. לכולם ברור שזה לא טוב, ובוודאי שזה רע בטווח הקצר. אבל עם כל כך הרבה שיקולים סותרים, לנסות ולצפות מה יהיה, זה כמעט כמו לנסות לקרוא את כדור הבדולח. כל תסריט כמעט אפשרי, ורובם אפילו סבירים.
