Income Tax


Was wondering if anyone has experience with income tax that needs to be payed in IL as well as your new country
?In my situation, I live in Belgium but did not cancel my IL residency, will I be required to declare and pay income tax in IL too
Any advise, or recommendation for a good CPA for such cases will be greatly appriciated

You can't cancel residency for income tax purposes

Residency for Israeli income tax purposes is determined based upon two criteria - an objective test relating to number of days spent in Israel per tax year (ie you are definitely a resident if you spend >183 days in Israel in a given tax year), and also a subjective test which examines where the "centre of your life" is - things that can indicate the centre of your life is still in Israel even if you live in a different country are, for instance, if your family lives there, if you have few or no personal connections with the coountry you reside in, but many such connections in Israel, if you own assets in Israel, if you own a flat in Israel and it is kept empty so that you can return at any time, etc.
As far as I am aware, you are not expected to pay Israeli income tax while you are abroad, and the examination of whether or not you were Israeli resident despite living abroad is done retrospectively on your return to Israel. However, I'm not entirely sure this is true, so I would consult an Israeli tax adviser who specialises on international taxation (and specifically, Belgian tax to provide relevant advice relating to the Israel-Brlgium tax treaty if such exists).

If the taxes that you were supposed to pay in Israel are higher than the taxes that you actually payed abroad, you may be requested to pay the difference. But I don't know anybody who was actually requested to pay that and I know a few guys who returned from the US where they almost certainly payed less taxes than what they would have in Israel.
