לאחר בדיקה ב-UKBA - מידע Surinder Singh Route
לאחר בדיקה ב-UKBA נראה שלא רשום במפורש 3 חודשים (ה-3 חודשים נלקח ממשהו אחר באתר של ה-UKBA שמדבר על שהות של אירופאי באנגליה) אבל היות וחיפשתי כבר שלל מידע על זה, רוב האנשים בהרבה פורומים (גם כאלה שעשו את המסלול וגם כאלה שנמצאים כרגע בתהליך) מדברים על כ-6 חודשי עבודה במדינה אירופאית כלשהי ואז המעבר.
יש גם זמן המתנה לאישור ה-EEA, לכן גם זו הסיבה לעד חצי שנה, היות ולפי מה שהבנתי הם אמורים לתת את האישור עד חצי שנה אחרי זמן ההגשה, אם כי לרוב זה מהר יותר.
הנה התשובה הכי ממצאת והכי טובה שמצאתי עד כה:
At least 6 months is the guideline (it is not absolute).
upto 90 days, you are able to remain in an EU country as a visitor.
so has to be at least 3 months
You also need to get a local EEA residents permit - and a place to live
and establish that you are genuinely working and residing in that country.
not just visiting and working, but still maintaining a home in the UK really.
(eg visiting and working)
Ideally, you would have obtained her local EEA permit for that country also.
where you were now resident (i.e. excercising your rights there)
All of that proof (previous EEA permit for you, and also her) would then support your UK EEA family permit application if you were to return (at some stage) to the UK.
3 months nominal 'game playing' is not really going to cut it.
so a summer job in a resort is not going to it for example, apart from it being defined as a temporary job anyway.
Know also that even the EEA permit is allowed to take upto 6 months to be issued
(in any country, but esp the UK with its UKBA shortages).
Yes, visitors (eg EU students comming in with their girlfriends) have (after some long discussions) been issued with short validity EEA family member permits (eg for 2-3 months for a summer visit), but don't expect as a UK citizen, to be able to march up to the border and gain entry readily - unless you could show that you still had your job and residence back in whatever country you were re-located to.

who knows may be life in one of the scandanavian countries would not be so bad
and you wish to remain there.
They are currently complaining (with more justification) of immigrants getting all their local benefits as new residents, as locals (with years of residence) do.
The Surinder Singh route, was if you recall visa Ireland.
despite the unemployment levels there, perhaps a possibility ?

the later bracketed part being the key point,
and also, all EU written legislation 'assumes' the EU means the open border area, even though it does not say it.
And so as UK is not in the Schengen area
and has chosen its own implementation it needs a seperate 'UK' Family member permit

ובנימה אישית - הלוואי והייתי יודעת את כל זה מזמן, גרנו באירופה כמה חודשים ועבדנו שם, ובכלל לא ידעתי את זה
